Lawyer Nickolaus Weiser found to have acted in conflict of interest and without integrity

In a recent decision of the LSBC Tribunal, Kamloops lawyer Nickolaus Weiser was found to have committed professional misconduct. The Tribunal found that Weiser acted in a conflict of interest when in four instances he had acted for a company in which he also had a financial interest and in one instance when he borrowed over $360,000 from a client. Additionally, Weiser was found to have acted without integrity when he executed a loan renewal agreement purporting to commit a client as personal guarantor without the knowledge and consent of the client. At the hearing, the Law Society argued that Weiser was deemed to have admitted the facts underlying the misconduct and had taken no steps to withdraw those admissions or give notice that he intended to introduce contradictory evidence at the hearing. As a result, the panel held that Weiser should not be permitted to testify or introduce evidence that would effectively be a withdrawal of those admissions. A sanction hearing will be scheduled at a later date to determine the appropriate consequences for the professional misconduct.
