At a prehearing conference held on October 3, 2023 and upon consideration of the audio recordings provided by the Law Society and on hearing Marsha Down, counsel for the Law Society and Russell S. Tretiak, KC, counsel for the Respondent, the motions adjudicator orders that:
 

1. The three (3) audio recordings are confirmed to contain the same content and shall be admissible without the need for additional witnesses; and
2. The transcripts of the audio recordings are not admitted.
