Prehearing Order

At a prehearing conference held today and on hearing Marsha Down, counsel for the Law Society, and Joven Narwal, KC, counsel for the Respondent, the motions adjudicator orders that: 

 

1. The Respondent's motion for anonymous publication of the Citation (the "Motion") is adjourned.
2. The parties will reset the Motion for a half-day hearing to occur within 31 days of today's date.
3. The Respondent must serve on the Law Society and file with the Tribunal any evidence and written submissions on which they intend to rely at least 7 days before the hearing. This deadline is peremptory: no late evidence or submissions will be considered by the adjudicator unless exceptional circumstances are demonstrated.
4. The Law Society must serve on the Respondent and file with the Tribunal any evidence and written submissions on which it intends to rely within 5 days after receiving the Respondent's materials.
5. If the Respondent seeks production of materials from the Discipline Committee, he must bring a separate motion in the proper form.
6. The paries will schedule a pre-hearing conference within 31 days of today's date. It may be held on the same day as the Motion, subject to the availability of the adjudicator and counsel.
