Prehearing Order

At a prehearing conference held on June 12, 2025 and on hearing Alex Kim, counsel on behalf of the Law Society, and Ian Donaldson, KC, counsel for the Respondent, the motions adjudicator orders that:

1. The hearing set for June 16-20, 2025 is adjourned to October 27-31, 2025 and is peremptory on the Respondent.
2. A further prehearing conference is set for September 5, 2025 at 9:00AM.
3. I direct that the Law Society may supplement and amend its materials as necessary as they receive the responses provided by the Respondent.
4. The Law Society has asked for costs of this proceeding. While I do not have the jurisdiction to award costs to the Law Society, I do make the recommendation that the Panel hearing this matter award costs to the Law Society for the adjournment application made less than 14 days before the hearing date. This adjournment motion, while successful, was made necessary only because the Respondent, contrary to suggestions by the Tribunal, failed to retain counsel in time to be prepared for the scheduled hearing.
