At a prehearing conference held on October 5, 2023 and on hearing Gagan Mann, counsel for the Law Society, the motions adjudicator orders that:
 

1. The prehearing conference scheduled for October 5, 2023 will proceed in the absence of the Respondent pursuant to Rule 5-5.1(5) of the Law Society Rules;
2. The facts and determination phase will proceed as a hearing in writing; and
3. If the parties are unable to reach an agreement respecting the deadlines for the exchange of written materials, they shall be at liberty to request a further prehearing to apply for such relief.
